This is great news. I am going through my divorce right now and have the divorce4her company assisting me in doing this. That is definitely one of my fears. That when the time comes to serve my spouse, he won't sign. Reading this has put my heart at ease, letting me know that after 30 days I have the right to go to the court if he doesn't sign and may still be able to win my divorce! Great advice. Thanks!

Hey I am soo happy to find this post. I visited the website mentioned and I am proud to say I'm sold. I am really excited to get this process started because my husband and I have been separated for about 14 years now. He has moved on and I am ready to do the same. I actually don't know where he is, but I was told by divorce4her that I can do a Missing Spouse Divorce. If he doesn't respond, as I think he's in a whole different city maybe country, then I can possibly win my divorce by default. This would be AWESOME!!! Yep that's right record roller. My mom actually went through a similar thing. I found a do it yourself company here that handles divorces that could turn into default divorce. My husband and I have decided to get a divorce. So it wouldn't be the same for us as we agree so will sign any paperwork needed till finalized. However, others that are not so lucky do have hope in knowing that it's possible to be granted a divorce even if your spouse doesn't sign the papers. Your spouse has a part in this too, he/she needs to take action if they don't want a divorce. If not, you could win without their consent. Divorce4her is the company we're going through. A whoooole lot less money and time than the average divorce. Jill

Hmm Interesting..
I'm new to this site and finding some great info and advice. Now, default divorce... My uncle went through his divorce maybe about 3 years ago. I do remember him mentioning he won his divorce by default. I was never really sure what it was and how it happened. So basically, if you spouse does not respond to the paperwork, you can go to your court after 30 days and let them know you would like a default divorce? See my uncle didn't have any trouble with his default divorce. It was granted and it stayed that way. He told me the best thing to do when serving your spouse divorce papers, is to do it certified mail. That way you KNOW they received it because it was signed for. So that would be proof for the judge to see that she/he did receive the paperwork and just plain out refuse to sign. Hmm, got me thinking, Thank you.
