Filing a Motion

This article describes the process of filing a motion and cross-motion in a divorce case.
When is a child old enough to speak in Court
I have a 10yr old daughter who unfortunately the court has deemed to live with her father. I became physically disabled a few years ago due to an accidnet. My daughter's father had money and could pay for expensive lawyers to get control. He now is the primary custodian of my daughter.I pick her up every other weekend, and the normal Summer and holiday schedule. I pay her father support and have been. I am struggling but always manage to pay her support first.I live about 1.5 hrs away from him due to my situation. I also insure my daughter have paid for an established all her medical care, and take her to all the appointments. My daughter begs me not to take her back to him. She has all her friends here where I live and doesn't want her father to have any part of it. She says he walks around in his bikini underwear, smokes alot and has lots of people over alot, currently someone is staying with him who lost custody of his son. I also just found out his house is being foreclosed on and now he is moving, he won't communicate to me at all. Is there anything I can do? My previous lawyer I got exactly what I paid for a cheap, careless lawyer who never even showed up for the trial. That is a whole other issue. Any suggestions are welcome. My daughter wants to be heard!
